1. Who these terms apply to

These terms are an agreement between RevisitMD Private Limited, which operates the RevisitMD platform ("RevisitMD", "we", "us"), and the doctor, clinic, or healthcare practice ("Clinic", "you") that creates an account to use RevisitMD. Patients treated by a Clinic are not a party to this agreement; they interact with RevisitMD only by receiving and replying to WhatsApp messages a Clinic has chosen to send them.

2. What RevisitMD provides

RevisitMD is a clinic management and patient engagement platform. It lets a Clinic manage patient records, visits, team accounts, and billing, and automatically sends WhatsApp messages on the Clinic's behalf, including post-visit medicine and symptom check-ins, revisit reminders, chronic-care reminders, and feedback requests.

3. Your responsibilities as a Clinic

• You're responsible for the accuracy of the patient data you enter into RevisitMD
• You confirm you have the right, under applicable law, to collect and share your patients' contact details and health information with RevisitMD, and to message them on WhatsApp about their care
• You're responsible for complying with any healthcare-specific regulations that apply to your practice and location
• You'll keep your account credentials confidential and notify us if you believe your account has been compromised

4. Acceptable use

You agree not to use RevisitMD to:

• Send messages to anyone who hasn't consented to being contacted by your clinic
• Send unlawful, harassing, or misleading content of any kind
• Attempt to access another Clinic's data or disrupt the platform's operation

5. Subscription and billing

Access to RevisitMD is provided under the subscription plan (Basic, Growth, or Pro) assigned to your Clinic, as described on our Pricing page. Plans are billed either monthly or annually, at your choice; all listed prices are final and tax-inclusive. You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and we don't provide refunds for the unused portion of a period already paid for.

6. Data ownership

Patient data you enter belongs to you, the Clinic. RevisitMD processes it on your behalf to provide the service described above. If your account is closed, you may request an export of your data within a reasonable period, as described in our Privacy Policy.

7. Data protection compliance

Both parties have obligations under India's Digital Personal Data Protection Act, 2023 (DPDP Act):

• As the Clinic, you are the "data fiduciary" for your patients' personal data: you decide what data to collect and why, and you're responsible for having a valid legal basis (ordinarily your patient's consent) before entering their information into RevisitMD or messaging them through it. RevisitMD's Add Patient screen requires you to confirm this consent for each patient before their record can be created.
• RevisitMD acts as your data processor for that patient data: we process it only to provide the service described in Section 2, following your instructions as expressed through how you use the platform, and we implement reasonable technical and organizational safeguards to protect it (see our Privacy Policy).
• If either party becomes aware of a personal data breach affecting patient or Clinic data on RevisitMD, it will notify the other without undue delay so both can meet their own notification obligations under the DPDP Act.
• Patients (or Clinics acting on their behalf) can exercise their DPDP rights (access, correction, erasure, and consent withdrawal) through our data rights request form, as described in Section 7 of the Privacy Policy.

8. Service availability

We aim to keep RevisitMD available and reliable, but we don't guarantee uninterrupted access. Scheduled maintenance, third-party outages (including WhatsApp's own platform), or issues outside our control may occasionally affect availability. RevisitMD is provided "as is," without warranties of any kind beyond what applicable law requires.

9. Limitation of liability

To the maximum extent permitted by law, RevisitMD's liability for any claim arising from your use of the service is limited to the amount you've paid us in the twelve months before the claim arose.

10. Termination

You may stop using RevisitMD and close your account at any time. We may suspend or terminate an account that violates these terms, misuses the platform, or fails to pay for an active subscription.

11. Governing law

These terms are governed by the laws of India, without regard to conflict-of-law principles.

12. Changes to these terms

We may update these terms from time to time. If we make a material change, we'll update the date at the top of this page and, where appropriate, notify Clinics directly.
